Welcome to Fabled & Found. Throughout these Terms, “F&F,” “we,” “us,” and “our” refer to Fabled & Found. We provide this website—including all information, tools, and services available from it—subject to your acceptance of these Terms, our Privacy Policy, and any policies or notices referenced here or available by link.

By visiting our site and/or purchasing from us, you’re using our Services and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, customers, merchants, vendors, and content contributors. If you don’t agree, please do not use the site.

We may introduce new features or tools from time to time; unless stated otherwise, they are covered by these Terms. We may update these Terms at any time by posting a revised version here. Your continued use of the site after changes are posted constitutes acceptance of those changes.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.

1) Online Store Terms

  • By using our Services, you confirm you are at least the age of majority in your state or province, or you have consent from a parent/guardian for any minor dependents who use this site.

  • You may not use our site or products for unlawful or unauthorized purposes, and you may not violate any laws in your jurisdiction (including intellectual-property laws).

  • Don’t upload or transmit malicious code (viruses, worms, etc.).

  • Any breach of these Terms may result in immediate termination of your access to the Services.

2) General Conditions

  • We reserve the right to refuse service to anyone, at any time, for any reason permitted by law.

  • Content you submit (excluding payment card data) may be transferred unencrypted over various networks and may be modified to meet technical requirements of connecting networks/devices. Payment card data is always encrypted during transfer.

  • You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our written permission.

  • Section headings are provided for convenience only and do not limit these Terms.

3) Site Information: Accuracy & Timeliness

Information on this site is provided for general purposes. We do not guarantee that content is accurate, complete, or current. You should consult primary, more complete or timely sources before making decisions. Your reliance on site material is at your own risk. We may change site content at any time, with no obligation to update any information.

4) Changes to Services & Prices

  • Prices and product availability may change without notice.

  • We may modify, suspend, or discontinue any part of the Services without notice.

  • We are not responsible to you or any third party for modifications, price changes, suspensions, or discontinuances.

5) Products & Services

  • Some items may be offered exclusively online and may have limited quantities. Returns or exchanges are governed by our Refund/Returns Policy

  • We try to display product colors and images accurately, but monitors/devices can vary—we cannot guarantee exact color matches.

  • We may limit sales to any person, region, or jurisdiction, and may set quantity limits case-by-case.

  • Product descriptions and pricing may change at any time. We may discontinue any product at any time.

  • We do not warrant that purchased items will meet your expectations or that errors in the Service will be corrected.

6) Billing & Account Information

  • We reserve the right to reject any order. We may limit or cancel quantities per person, per household, or per order (including orders placed under the same account, payment method, or billing/shipping address). If we change or cancel an order, we may attempt to notify you using the contact details provided at checkout.

  • We may restrict orders that, in our judgment, appear to be placed by resellers, dealers, or distributors.

  • You agree to provide current, complete, and accurate purchase and account information, and to promptly update it (including email and payment details) so we can complete transactions and contact you as needed.

7) Optional Tools

We may give you access to third-party tools that we neither monitor nor control. You acknowledge that these tools are provided “as is” and “as available” without warranties, representations, or conditions, and without endorsement. Use of such tools is at your own risk and subject to the third party’s terms. Future features/services offered through the site will also be subject to these Terms unless stated otherwise.

8) Third-Party Links

Our Services may include content, products, or services from third parties. Third-party links may direct you to websites we don’t operate or control. We’re not responsible for examining or evaluating third-party content or accuracy, and we’re not liable for any third-party materials, sites, products, or services. You agree your submissions will not violate any third-party rights and will not contain unlawful, abusive, or obscene material, malware, or anything that could affect site operation. Do not use a false email, impersonate another person, or mislead us or third parties as to the origin of submissions. You are solely responsible for the content you provide.

Your submission of personal information through the store is governed by our Privacy Policy. 

11) Errors, Inaccuracies & Omissions

From time to time, the site or Services may contain errors or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct errors, update information, or cancel orders if any information is inaccurate—at any time and without prior notice, including after you’ve submitted an order. Except as required by law, we have no obligation to update or clarify information in the Service or on any related site.

12) Prohibited Uses

In addition to other prohibitions in these Terms, you may not use the site or its content:

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable. We may remove the Services for indefinite periods or cancel them at any time, without notice.

Except where stated otherwise by us in writing, the Services and all products delivered through the Services are provided “as is” and “as available,” without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

To the fullest extent permitted by law, Fabled & Found (and our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, and licensors) will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, arising from your use of the Services or any products, or for any other claim related to your use of the Services or products (including errors or omissions, or any loss or damage of any kind). In jurisdictions that do not allow exclusion or limitation of incidental or consequential damages, liability will be limited to the maximum extent permitted by law.

14) Indemnification

You agree to indemnify, defend, and hold harmless Fabled & Found and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand—including reasonable attorneys’ fees—made by any third party due to or arising from your breach of these Terms or the documents they incorporate, or your violation of any law or third-party rights.

15) Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed. The remainder of the Terms will remain valid and enforceable.

16) Termination

These Terms remain effective unless terminated by you or us. You may terminate by notifying us you no longer wish to use the Services or by ceasing to use the site. If, in our judgment, you fail (or we suspect you have failed) to comply with any Term, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. We may also deny you access to our Services (or any part thereof).

17) Entire Agreement

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements and communications. Any ambiguities in interpretation shall not be construed against the drafting party.
